Planning and Timing

Before diving into the document requirements, it is crucial to plan your wedding in Sardinia well in advance. Allow sufficient time for gathering the necessary paperwork, as well as for any translations and legal processes. Aim to start the process at least 6-9 months before your desired wedding date. Bare in mind that documents issued outside of Italy are valid for 6 months, after this time period documents expired and you need to restart the all process.

1. Certificato di Nascita (Birth Certificate)

The first document you will need is your birth certificate. Obtain an official copy of your birth certificate from the vital records office in the state where you were born. Make sure the certificate includes your full name, date of birth, and the names of your parents.

2. Nulla Osta

The Nulla Osta, or “Certificate of Non-Impediment to Marriage,” is a crucial document issued by the U.S. Consulate or Embassy in Italy. It confirms that there are no legal impediments to your marriage and that you are free to marry. To obtain the Nulla Osta, you will need to provide the following documents:

  • Valid Passport: Ensure that your passport is valid and will not expire before your wedding date.
  • Declaration of Intent: You may be required to submit a sworn affidavit, declaring your intent to marry and confirming your marital status.
  • Proof of Divorce or Death: If you have been previously married, provide the divorce decree or death certificate of your former spouse.
  • Translations: You will need to have your documents translated into Italian. These translations must be certified by a professional translator.
3. Atto Notorio

The Atto Notorio is another essential document required for getting married in Sardinia. It is a sworn affidavit that attests there are no legal impediments to your marriage. You can obtain the Atto Notorio at an Italian consulate in the United States or at a local court in Sardinia. The required documents may include:

  • Passports: Provide a copy of your passports.
  • Declarations of Witnesses: Depending on the location, you may need two to four witnesses to sign declarations attesting to your identity, eligibility for marriage, and freedom to marry.
  • Proof of Residence: Some municipalities may require proof of your current residence.
4. Translations and Apostille

Ensure that all your non-Italian documents, such as the birth certificate, Nulla Osta, and Atto Notorio, are translated into Italian by an official translator. Additionally, obtain an apostille for each document from the Secretary of State in the state where the document was issued. The apostille certifies the authenticity of the document.

5. Civil or Religious Ceremony

In Sardinia, you can choose to have a civil or religious wedding ceremony. For a civil ceremony, you will need to schedule an appointment at the local town hall (comune) in the municipality where you plan to marry and finalize all documents.

If you prefer a religious ceremony, consult with the chosen religious institution or clergy for their specific requirements and procedures.

You are now ready to get married!

Planning a wedding in Sardinia as an American requires careful attention to the legal requirements and documentation. Start the process well in advance, ensuring you have all the necessary paperwork, translations, and apostilles.
